H1B 5th year started. H1B expires in OCTOBER 2013. Labor Filing is in process.

Hi,

I am on H1B 5th year now and it expires in October 2013 which means i still have 1 year 7 months. I am a full time employee.

My current company is filing Labor in April 2012. I may get an offer from the other company most probably in April. Will i be able to change to the other company as long as they file the GC immediately before October of 2012.

or Is it safe to change after my I-140 gets approved likely to be before October 2012.

Could someone help me decide on this issue.

You should probably change your company now rather than after getting the I-140 approved because you cannot use the approved I-140 for H1b extension if you are no longer with that company.
