H1B Transfer Questions

Hi,

I am in India and hold a valid H1B visa. The visa is issued in the name of a company A. However they delayed my joining date by 6 months, and I have not joined them yet. In the meantime I got a better offer from company B and intend to join it. Company A does not know of my plans to shift to company B. Company B will be initiating the H1B visa transfer process very soon.

My questions:

1) During the visa transfer process, will company A know about it?

2) After company A knows that I plan to join another company B, I guess they have the option to withdraw the petition they had filed. In case this is done, will my visa also be void. Does it mean I’ll have to apply for another H1B visa and go to the consulate again for another interview. Or will my visa still be valid, and only the petitioner will be changed?

A transfer is just a normal new H1.

If you have a valid H1 visa, you can use that visa together with the new approval notice to enter.
