h1binformation Posted March 5, 2012 Report Share Posted March 5, 2012 Hi, I was laid off while on OPT. My 12 months of OPT expires on 31st March. The previous employer had already filed for H1 which was effective starting 1st of April. Question- 1. How long can i stay in US after my OPT expires on 31st March? 2. Is my H1 valid? It was a transfer of status from F1 to H1 and was cap exempt as I had an H1 before changing status to F1 from H1 to go to school. 3. If a new employer gives me a job can they transfer this H1 or do they have to file for a new change of status from F1 to H1 and will it be cap exempt Please help Link to comment
kalyan_ac Posted March 5, 2012 Report Share Posted March 5, 2012 Since you are laid off, the company may revoke the petition in which case you will be out of status from April 1st. You will have to find a new employer and file for H1b petition and you will be cap-exempt. Link to comment
