H1 to H4 conversion: paytub requirement

Hi,

I entered US on H4 visa (valid till 2013). Then I applied for H1 and got approved as COS but I haven't been able to find project after 30 days. Hence I don't have any paystubs yet.

If I apply for H1 to H4 as COS, will I be asked for paystubs?

What is the max period before which I would have to apply for H1 to H4 without being out of status.

Your employer should find a project for you.

You need to get paid, even iwthout a project. That's the law.

That's also why your employer should be interested in getting you a project.

You are out of status if you don't get paid. There is no grace period.

If your employer doesn't want to pay you, file a complaint with DOL on form WH4. The DOL will make the employer pay you.

A pending WH-4 also allows you to change status, e.g., to H4.

If your H4 stamping is valid, then easy way is to re-enter on H4.
