Then I applied for H1 and got approved as COS but I haven't been able to find project after 30 days. Hence I don't have any paystubs yet. If I apply for H1 to H4 as COS, will I be asked for paystubs? What is the max period before which I would have to apply for H1 to H4 without being out of status. Appreciate your advice. Thanks Link to comment
JoeF Posted February 26, 2012 Report Share Posted February 26, 2012 Your employer should find a project for you. You need to get paid, even iwthout a project. That's the law. That's also why your employer should be interested in getting you a project. You are out of status if you don't get paid. There is no grace period. If your employer doesn't want to pay you, file a complaint with DOL on form WH4. The DOL will make the employer pay you. A pending WH-4 also allows you to change status, e.g., to H4. Link to comment
