As my company will not process Green Card, will it be possible if my wife applies for GC can I add myself as part of the process even though I'm in L1A? What is the maximum period my wife can stay in US with H1B status or over all? Link to comment
toobrown Posted March 11, 2012 Report Share Posted March 11, 2012 Yes, your wife can certainly file for GC and your name can be included, when she files for I-485 (AOS). Every H1B Candidate is allowed to stay for a maximum of 6 years. One can obviously, extend that beyond 6 years in the following scenarios 1. If your Labor is cleared, you get 1 yr extensions, after completion of 6 yrs. 2. If your I-140 is cleared, you are eligible for 3 years extension, after completion of 6 yrs.
