I would like to know if she is eligible for the $1000 child tax credit. (She is here for more than 183 days which the IRS requires to be considered as a resident alien for tax purposes). Me and my family relocated to India in March '2013 after staying in US for few years . So me and family are considered as resident aliens as per SPT (Substantial presence test). But they didnt stay in US for more than 183 days. As per the rule, it says child should have "Lived with you more than half of 2013. " It doesnt clarify if it has to be in US. In my case my children stayed with me for the entire year of 2013, but not in US it was only 90 days in 2013. Can I claim child tax credit? Link to comment
