aarora3 Posted February 25, 2012 Report Share Posted February 25, 2012 Hello All, I am on my 7th year of H1b visa and it is valid until 02/28/2014. I got a 3 year extension after 6 years on H1b because I have an approved I-140. If I decide to change my employer and when they file my H-1b transfer, lets suppose they file on 03/01/2012, is the H-1b going to be valid for another 3 years i.e. until 03/01/2015 or will it be valid based on my current H-1b expiry date i.e. 02/28/2014? mukeshsehgal Posted February 28, 2012 Report Share Posted February 28, 2012 USCIS will issue a new 797 against your new employer. That term could between 1-3 years with max of your current date i.e. 02/28/2014 Link to comment

If the new employer is not willing to sponsor GC and the old employer does not cancel the approved I140, can another 3 year H1B extension be obtained beyond 2/28/2014 based on the approved I140 with the old employer?
