I got an extension upto sep 2013 because of a pending labor application with dol (audit state) from my current company. I am planning to leave my current company. The new company is ready to start processing my labor application immediately upon joining (march 2012) and plans to file the labor application sooner. If I leave my current company will the h1 extension I have received from the pending labor application would be revoked? Is it safer to leave the current company and join new company now? What will be the worst case scenario If I decide to join the new company now? Please advice, your help is highly appreciated. Link to comment
noauditplz Posted February 29, 2012 Report Share Posted February 29, 2012 your extension was based out of labor petition from your current company.if your current employer revokes the perm, then your transfer will enter an RFE state to prove that you have a pending immigrant petition. safe way is to have your new employer to apply for labor and get it approved before you transfer your H1B Link to comment
