arcad Posted February 23, 2012 Report Share Posted February 23, 2012 I am beyond the 6 year H1b cap but currently have an approved PERM and pending I-140 with 1 year extension for H1b.... What happens to H1b visa if I-140 is denied or revoked by employer before 180 days have passed since I-485 is filed? Does that invalidate the H1b visa also? Am i out of status ? What options / timeframe do I have to appeal or look for a new employer? thanks! Link to comment
Belle Posted February 24, 2012 Report Share Posted February 24, 2012 Your H1 remains valid until it's expiration. You would not be able to file an H1 extention if you don't have another case in the works. Link to comment
