macu Posted February 20, 2012 Report Share Posted February 20, 2012 Hello, Recently I just got into this problem, and would like to ask for some advise: My H1-B is about to expire in June 22,2012 and my PERM will be filed in March 26,2012. My attorneys told me, that in order to apply for an extension of visa, I need to get my I-140 approved, since my visa is about to expire they told me that I can apply for TN visa after I file PERM and when it gets approved I can go back and change status to H1-B for the remaining time (about 2 1/2 months) so I can file I-140 with premium processing and then apply for visa extension until I-485 is approved. Can someone tell me if all this is right and I can go from H1 to TN and back to H1 to file I-140? Link to comment
