RESPONSE Posted February 20, 2012 Report Share Posted February 20, 2012 Hello friend, I was in H1B status .But i married to USA citizen girl that why i got the temporary green card which is expire in 2 years .Right now our relationship is not going well. I want to go back to my H1 status .So ,can i apply for the H1b visa? My sponsor is ready to put the file for me .Generally, H1b non immigrant visa is convert in to immigrant visa. But my process is reverse. This is like immigrant convert in to non immigrant. So I have confusion So give me proper advise for my question. Thank you vey much... Link to comment

JoeF Posted February 20, 2012 Report Share Posted February 20, 2012 You can certainly surrender the GC. But you would have to do that while outside the US, since you wouldn't have any status as soon as you give up the GC. An employer can then of course file an H1 for you. Link to comment
