h1b6yr Posted February 19, 2012 Report Share Posted February 19, 2012 Plz pour in your thoughts... heres the situation - We applied for h1b in September 2006, we received 2 rejections and finally got our visa in Nov 2007 stamped at the Chennai consulate... We are planning to file labor next month. Heres the question... will i get h1b extension when i file for labor (6yr rule scenario) in other words will petition date (2006 Sep) be considered or the date I got my h1b stampted when the 365 days rule comes into the picture for my 7th yr extension... nipukumar Posted February 23, 2012 Report Share Posted February 23, 2012 There is no grantee that you will get extension on labor. Your 1st entry date to the US on H1B will be considered towards 6 years of H1b. No visa stamping or petition file date will be considered. Link to comment
