Since then, there have been some changes and they will be able to stay in the US for only 2 to 4 months in a year. 1) Should they surrender their GCs voluntarily, since they will not be able to stay for majority of the time in US? 2) If they keep the GC, but only stay in the US for 2 to 4 months in a year, will USCIS revoke the GC due to intention of abandonment? 3) If they surrender the GC or it is revoked by USCIS, will there be any issues in using their existing visitor visa (valid till 2105) or a new visitor visa to travel to US? Nick-Boston Posted April 28, 2012 Report Share Posted April 28, 2012 Ideally you should surrender the green card and simultaneously apply for new visitor visa. Their existing visitor visa is no longer valid as their current status is GC. Link to comment
