sameern Posted February 15, 2012 Report Share Posted February 15, 2012 A friend told me that in EB2, I can apply for I-140, I-485 and EAD/AP all at the same time and I can receive a EAD in 90 days after filing. Is that true? I really appreciate any input in this regard. Thanks! Link to comment
JoeF Posted February 15, 2012 Report Share Posted February 15, 2012 If the PD is current, the I-140 and I-485/EAD/AP can be filed concurrently. If the PD is not current, you would have to wait for the PD to become current before filing I-485/EAD/AP. Link to comment

No better way to get the query clarified than from the best two “member” authorities on this forum! J I am currently on H1 and my wife on H4. When my PD becomes current, I want to do the following. Please let me know if that works. Thanks! I will file for I-140, I-485 and my wife will file for I-485, EAD. I believe it is currently taking about 90 to 100 days to get the EAD. Even when my wife gets the EAD, I would still like to maintain H1 so that if my I-140 or I-485 runs into any issues I can get her back into H4. Link to comment
