Entering 6th yr but Labour not started

Dear sirs,

We came to Usa in June 2007.My husband had to change 2 jobs in between 2007 to 2011 bcas of recession.

Now the new company said that they will start GC in 2012 jan becasuse our 6 yrs would be done by June 2013.But its feb now & they are not starting the green card processing.If this company does not start before june 2012 what would be the options left for us.Can the labor be filed even in the 6th year or it shd be 365 days prior?Pls give us some insights into our situation.

If only, the labor is approved, he is eligible for 1 yr extension, beyond the regular 6 year of H1. However if he has an approved I-140, he is eligible for 3 yrs extension.
