IN january 2012, I got it rejected stating that Employee referral program didn't mention about incentives offered. What is the best way to continue from here- To apply for reconsideration or apply a new PERM/ If attorneys apply for reconsideration, will this come under department error and DOL process it quickly or will it take years of time and will I finally get approved? For a new PERM, can I file it with the same company while applying for reconsideration as well. Thank you so much!! Sri Link to comment
karlpatrik Posted February 10, 2012 Report Share Posted February 10, 2012 You cannot have Motion to Reconsideration (MTR) and also file for a new PERM together. If you file for MTR, and you plan to file a new PERM...you need to withdraw the later and start a new PERM. Typicall MTR takes longer time to come back...i read somewhere the average times are like 20 months. Link to comment
