Meantime I have filed my I-485 last month concurrently referencing EB3 PD Jun 07. I have just received FP notice, say if I go for it and gets processed, will I get my EAD even if my EB2 140 gets rejected (worst case) ? What will happen to my EAD, if 140 gets rejected ? What will happen to my concurrent I-485? it has category EB3 spcefied and its priority date ? RFE is for missed employer(though shorter duration, 4 months) in EB2 labor and 140. Also prove employer employee relation similar to H1. experts comment please Link to comment
Belle Posted February 10, 2012 Report Share Posted February 10, 2012 If your I-140 was accepted, it was not rejected. The opposite of 'approved' is 'denied'. Obviously, if your I-140 is denied, you lose your eligibility for I-485, and that petition will be denied as well. Most people appeal denials. Link to comment
