pandu_123 Posted February 9, 2012 Report Share Posted February 9, 2012 Hi Maintenance of status Evidence in the record indicates that the beneficiary is currently enrolled at the university of Northern Virginia(****).On August 6, 2008,**** lost its accreditation as a U.S institution of higher education.On July 28, 2011,**** was issued a notice of intent to withdraw the school's SEVIS certification.In view of this,USCIS requires additional documentation to establish that he beneficiary was maintaining a valid F-1 nonimmigrant status at the time you filed this petition. In ordeer to verify that the beneficiary is actually a student classes and maintaining a valid F-1 nonimmigrant status at ****,please submit the following evidence: -A copy of the beneficiary's official transscript from ****; -A copy of the beneficiary's most recent grade reports from ****; -Proof of tuition payments to ****; -Receipts for books and school supplies; -A copy of the beneficiary's residence in or around the **** campus area for the duration of the time he or she has been a student at ****. Full Course of Study The evidence contained in the record indicates that the beneficiary has been living and working in Tennessee.It is unclear how the beneficiary could be attending classes in Manassas,Virginia.According to ****'s website at www.****.edu <http://www.****.edu/>,the school does not have a campus within commuting distance of this location.Therefore ,please provide the following: -Evidence that **** has a campus within commuting distance of where the beneficiary is living and working;and/or -Documentation of the number of on-line/distance courses vs. in-person credits that the beneficiary has taken. JoeF Posted February 9, 2012 Report Share Posted February 9, 2012 So, why were you working in Tennessee when you claimed to be studying in Virginia? It looks like you abused CPT. Such abuse always comes back to bite. You may be considered to be out of status. And I hope you didn't try to use a fake degree from **** for the H1. You should discuss your situation with a good immigration lawyer. Link to comment

JoeF Posted May 3, 2012 Report Share Posted May 3, 2012 Were you also working on CPT outside of normal commuting range from ****? If so, forget it. On CPT, you still have to fulfill the F1 rules, and that means that you have to attend classes in person. Only one class/3 credits can be online. You should have realized this no later than the raid on TVU, which was all over the news, in particular in the Indian media. If you stayed one minute longer after the TVU raid, it is basically your own fault. After the TVU raid, nobody can claim "I didn't know" anymore... Link to comment
