knadipalli Posted February 8, 2012 Report Share Posted February 8, 2012 Hi, I have a bachelor of science in nursing (BSN) and a registered nurse license (RN). I have 1.5 years of experience as RN in the ICU of a local hospital. 4 months ago I got promoted to Clinical Coordinator for ICU. The position requires a bachelor's degree, so I convinced the HR in the hospital to hire an immigration attorney to apply for H1B (I'm the first foreign worker for the hospital). The attorney is saying that we will have an extremely difficult time convincing USCIS that the Clinical Coordinator position is an H-1B qualifying position. The publicly available information and job postings on this position are not favorable to the argument. USCIS Officers are routinely conducting google searches for positions that claim to be H-1B positions, and we will have no defense to the fact that many available positions are requiring less than a BSN or its equivalent. Is there anyone else in the same boat? Any suggestions/solutions? Thanks Link to comment
