volverine_27
My current H1B is due to expire in April 2012. Since I had an approved labor and I-140 (EB2), my employer filed H1 extension for beyond 6 years. Now my new H1 is valid from April 2012 to April 2015. My wife wants to go for H-4 visa. She has her interview next week. Now, we filled her forms based on the new H1B petition (apr 2012 - apr 2015). I sent her all the H1B papers for the new H1. She wants to come to US in Feb itself (after getting the H4). I am concerned that we showed the new H1B information but did not mention about the existing H1B (which is expiring in Apr 2012). Should I send her the existing H1B docs scanned copies? Can she carry the existing H1B papers as well with her for the interview? Please help. Link to comment
Chitown01
Should I send her the existing H1B docs scanned copies?: Yes, doesn't harm to carry additional documents. Can she carry the existing H1B papers as well with her for the interview?: yes, why not.... she can carry as many documents she want Link to comment
volverine_27
Thanks... but will it be an issue for getting the H4 stamping right away or USCIS may stamp her H4 starting april 2012 (since we filed her papers based on my new H1 which starts in apr 2012) Link to comment
Chitown01
From what i understand the they would stamp based on the petition start date Link to comment
rrr2008
Hi Volverine, 1. Is your wife going for H4 for the first time? but will it be an issue for getting the H4 stamping right away or USCIS may stamp her H4 starting april 2012 (since we filed her papers based on my new H1 which starts in apr 2012) I think so, I guess it is better to take an appointment with current H1B and show the extension to the visa officer. They may ask the currennt pay stubs and w2 forms. It is not like a new H1B correct. Talk to you attorney and take a suggestion from them too. Send both the documents, the current one and the new one.
