kartheek1440 Posted February 5, 2012 Report Share Posted February 5, 2012 Dear All, I work for a full-time Company in New Orleans and my H1-B is being hold by them, Last Week I got Laid Off since my H1-B is being hold by them I have to transfer my H1-B. My Enquiries are: 1) How much time do I have inorder to find new employer and file the H1-B from him. 2) Suppose in worst case if I have to leave the country since I didn't find any employer to file for my H1-B will I be getting the 60 day grace period to stay in the US. Chitown01 Posted February 6, 2012 Report Share Posted February 6, 2012 There is NO grace period on h1 You are out of status on the last day of your work. 60 days grace period is for f1 students and NOT H1. Contact an attorney asap. Link to comment
JoeF Posted February 6, 2012 Report Share Posted February 6, 2012 You are out of status from the day you are laid off. There is no 60 day grace period. If you want to leave the country, the employer by law has to pay for your flight. Link to comment
