sweetgal09 Posted February 2, 2012 Report Share Posted February 2, 2012 Hi, My first 3 years of H1 expires in April 2012. I have not applied for renewal as yet. In the meanwhile if I change jobs (without renewing the H1 and before the expiry) and my new employer (fulltime) is ready to do a transfer, will the transfer appliation also take care of renewal for 3 years or should the renewal application be handled separate from the transfer application i.e. the new employer has to do both transfer as well as renewal? Will there be additional fees involved? Thanks! Link to comment
Chitown01 Posted February 2, 2012 Report Share Posted February 2, 2012 There is Nothing like transfer it is always a new petition which will be cap exempt since you were counted towards the cap in the past. If you change jobs, your new employer will file a new H1 petition with Extension of Stay (So its one thing and not two different things like transfer and renewal) and with approval it shall be approved for 3 years (unless the new employer is consulting) No additional fees, regular H1 fees Link to comment
