I have spent enough time at manegerial postion in India for the same company . Last one year I am in US and my company is filing my GC under EB1 category. I am in process of H1-B with another company who is sponsoring me H1-B visa, result of which is due soon. My question is weather should I stay with my current company even H1B is approved, hoping my GC will be processed soon? What are chances of getting GC if I am on L1-B visa? Link to comment
Belle Posted February 2, 2012 Report Share Posted February 2, 2012 Once H1B is approved with COS, you are supposed to work for the H1 employer, or otherwise you will be out of status. When filing I-485 you are expressing your honest intent to work for the sponsoring employer upon approval of the petition indefinitely. If you file it without such intent, your petition may be found fraudulent. You have issues. You really need to talk to a lawyer. Link to comment
