KarSugKri Posted January 31, 2012 Report Share Posted January 31, 2012 My 7th yr H1B started just a month ago. Using the approved I-140, I applied for H1B transfer and extension to a new company. Until this minute, the online status shows that the I-140 is approved. Whereas, I got an RFE today saying that the I-140 was revoked 1 year before. I never knew it until I got the RFE. I was confident that the H1B extension will pass through as the online status of I-140 is still approved. Is it good to respond to RFE saying that the online status of I-140 was approved (not revoked) when I submitted the H1B transfer and request them to approve the H1B based on this fact. I am not sure what are the other options I am left with. Can anyone help me on this. Thanks... Link to comment
Chitown01 Posted January 31, 2012 Report Share Posted January 31, 2012 Online Status are Not Reliable... Its Not a good idea to say online status shows its approved, so it has to be approved.... Your previous employer might have revoked your I-140 and USCIS has evidence of that, hence they are issuing an RFE, you can check with your previous employer if they actually revoke I-140 or not Online Status is just for Reference, it cannot be used as proof.
