Now my role has changed (same employer) beyond my minimum requirement. Also, my new role utilizes skills gained during my existing role (for which the PERM and 140 was approved). My questions are 1. Does my PERM need be be re-filed? 2. If PERM is to be re-filed, for the new role, can i use the experience gained during my old role? 3. If PERM is to be re-filed, can i port the priority date? 4. Does using experience gained in a different role, but same employer add audit risk to the PERM process? Thanks Link to comment

bhp1234 Posted February 2, 2012 Report Share Posted February 2, 2012 I have a somewhat similar situation...EB2 PD is 09/15/2011. PERM and I-140 are approved but very recently had to take up another position within the company and hence have to re-start the PERM. But the question is that if let us assume my PD is current in 2 months and the new PERM is not yet filed - can I file I-485 based on the previous approved PERM or do I have to wait until the new PERM is approved after which I can concurrently file I-140 and I-485?
