gcissues2010
My company filed EB2 labor application with qualification requirement of Master Degree which got approved and then filed I140 for me. I have a 3 years bachelor’s degree+ 3 years Master’s degree and 11 years of US experience. They filed the AACRAO evaluation after I140, which came out to be equivalent of US Bachelor’s degree + 1 and subsequently I140 application was rejected for not meeting the job’s degree requirement. What can be done at this point to salvage the I140 application? Link to comment
schintala
Your PERM job requirement should be made as Bachelor's with 5 years of experience. USCIS considers 3 + 3 degress are equivalent to US bachelors. Link to comment
gcissues2010
Thank you for your response. Can the current approved labor be changed from Master's degree to Bachelor's + 5 years experience or does it have to be a new PERM filing? Link to comment
schintala
No. It has to be new PERM filing with the new job requirement. Link to comment
