bhatgau Posted January 19, 2012 Report Share Posted January 19, 2012 I went for my 3rd h1b extension with same employer to kolkatta and they gave me a 221g on dec 30th. they dint ask for any documents but they kept my passport. Yesterday I got my EAD/AP (eb2). I no longer need a visa to travel but my passport is with the embassy. Should i just wait the processing out or should i write to the embassy, request my passport back and return on EAD/AP I am allowed to WFH but client is getting a little impatient. Not sure how long this administrative processing will take? Also does abandoning my 221g process impact my 485 processing (eb2) ? Kindly suggest Link to comment
Attorney_10 Posted January 27, 2012 Report Share Posted January 27, 2012 Generally, one may not use Advance Parole to enter the U.S. if it is approved when the applicant is outside the U.S. The Advance Parole must be issued while the applicant is still in the U.S. Please schedule a consultation with a qualified immigration attorney to discuss the specific facts relating to your case and the different options that may be available to you.
