I140 EB2 NIW application - NOID

Folks looking for some input here.

I have an EB2 NIW petition filed in Oct 2010 which I received an Intent to Deny notice for. The reason is that we have not been able to establish that my job will benefit the country.

We're in the process of replying back to this but my attorney is saying that the chances are less (would've been better if it was an RFE). Anyone here know what are the chances of an approval after an NOID?

I am in my 7th year of H1B and I'm due for a renewal soon.

Any input on the matter is highly appreciated.
