Labor Salary Issue for 485

Hi

Mine is a porting case. I got my 140 ported from previous employer.

I am current, but my company was delaying in filing my 485.

I had a word with my company and they told me that my previous employer(most likely they themselves have quoted) in the labor the salary which is 20k more and therefore they cant file my 485.

Gurus, once the new employer files a new perm. It is the salary whcih is listed in new labor which matters and not the one which was mentioned in prev. emplioyer labor, correct?

Are they delaying and giving me an excuse as they will have to pay me the salary listed in labor once my GC gets approved?

Please suggest me what are my options
