Urgent H1B extension question

I was working for company A with H1B approved till Feb 3, 2012. This was 7th year extension based on approved PERM and pending I140 in 2011 through company A .

On Nov 28, 2011, company A was completely merged with Company B - which also became Successor in interest of my H1B petition and approved I140. Now I am applying for H1 extension through Company B.

Have 2 questions,

1. Will this H1B petition be "Amended petition" or "change of employer" ( Page 2 of I129)

2. "Will this be a second or request of extension with the same employer" ( Page 17 of I129)

Attorney feels it should be "amended petition". I feel it should be "change of employer".

Any thoughts or insight? Especially Belle, JoeF?
