H1B stamping in 6th year

Hello all

I am in my 6th year of H1b. i recieved my i-797 extension recently and it ends by dec 2012.

My last H1b visa stamping expired in Feb2010.

I have applied for perm and its still under process.

I have to travel to India in June. So i am planning to go for H1 stamping to Canada before that.

So my question here is

1. will there be any problem for me to get H1B re stamping in canada as my old stamping expired in 2010.(i have 797 till dec 2012)

2. And as i dont have PERM or I-140 will the consulate deny stamping because i am only left 10 more months?

Any suggestions and expert advices and answers are welcome.
