vendy9999 Posted January 13, 2012 Report Share Posted January 13, 2012 am currently out of US, and will be back only after 3 months.. can i file my i485 even being out of US and request for a consular processing.what will be the possble issues because of this. also, i will not be filing the EAD and AP and will continue to be on h1b until end of next yr,since i have my visa stampingg valid unilt then.. kindly advise Link to comment
JoeF Posted January 13, 2012 Report Share Posted January 13, 2012 You have to be in the US to file an I-485. The process for consular processing doesn't involve an I-485. You would have to an I-824 to get CP rolling. You will then get contacted by the National Visa Center (NVC) to pay the fees, and then the file is sent to a consulate in your home country. The consulate will then invite you for an interview. That whole thing takes more than 3 months. Link to comment
