grengaster
My parents have been GC holders since Sept.2007. In April of 2010, they decided to apply for re-entry permit, allowing them to stay in India for 2 years while my dad underwent some medical treatment. The re-entry permit is valid until April 2012. Unfortunately, my dad is still in the midst of the medical treatment and will need to see the doctor for another 6-8 months. Is it possible to appeal for an extension of the re-entry permit for another 6 months to a year without risk of losing their GC status? Kindly advise. Thanks! Link to comment
JoeF
A reentry permit can not be extended. He would have to apply for a new reentry permit, but that can only be done while he is in the US. Link to comment
grengaster
Thanks for the prompt response. So,is there any way my Dad can maintain his GC status without having to make a trip to the US? He is not in a condition to travel at this time, and God willing, he should be in a better shape in about 6 months or so. He is currently in India, so ideally if something can be done in India itself, that will be great. I would hate for him to lose his GC status. Please let me know. Thanks! Link to comment
JoeF
If the stay abroad is prolonged for reasons beyond his control, he may be able to get a returning resident (SB-1) visa. See http://travel.state.gov/visa/immigrants/info/info_1333.html Link to comment
