Travel outside US during employment gap

My H1-B employer had to wind down the company on Dec 31, 2011 due to tax reasons. They are in the process of incorporating a new company to transfer my H1-B. In the interim I need to travel outside the US for 10 days. I have the H1-B visa on my passport until 2014. Can I make the 10-day trip and return? Please advise. Thanks,

You can not come back until the transfer is approved.

And besides, you are illegal right now, since you are not employed by anybody.
