Mycurrent project/contract is ending on 02/28/2012 so I am willing to travelto take a break before joining new assignment.My first 3 year H1B Petition and H1B Visa are expiring on 04/07/2012.I am applying for H1B Extension this week in regular processing/premium processing.I want to travel to India on 02/28/2012 and return by 03/28/2012 before my visagets expired in order to avoid going for H1B visa stamping.(1)If I go for regular processing, I will have only the I797A receipt copy, What are my consequences at the immigration officer when I enter on 03/28/2012 to USA since my H1B visa will be expiring on 04/07/2012 which has a gap of 10 days only.(2) Suppose if I go for premium processing, and if I have the approval H1BExtension Petition, what are my consequences when I enter on 03/28/2012 sincemy H1B visa will be expiring on 04/07/2012 which has a gap of 10 days.(3) Is it advisable to go with Premium processing for the H1B extension in the current situation since USCIS is giving lot of queries and finally rejecting them.
