joshh02 Posted January 9, 2012 Report Share Posted January 9, 2012 My H1B is valid till October 2013 which came through my previous employer. I quit that employer in October 2011. Then my new employer filed for the H1B transfer in October 2011 itself. Now I have decided to go back to my old employer. Will I be able to start the employment there without filing another change of transfer? The transfer filed by my new employer is still coming pending ( I-129), can my old employer file a fresh application? PS: My old employer confirmed that they have canceled my H1B after I left them in October 2011. But they are ready to go ahead with fresh application if be needed. Link to comment
JoeF Posted January 9, 2012 Report Share Posted January 9, 2012 The old company was required by law to tell USCIS that you no longer work there, and have the H1 canceled. If you go back there, they have to file a new H1 for you, just like in every other transfer case. Link to comment
