Attorney_10
Generally, individuals outside the U.S. are not subject to U.S. immigration laws. Generally, an indvidual may apply for a visa to the U.S. at any time as long as s/he is eligible for the particular visa classification. For H1B visas, the applicant must have an approved, valid H1B petition and the terms and conditions of the H1B petition must still exist at the time of applying for the visa. Please schedule a consultation with a qualified immigration attorney to discuss the specific questions relating to your issues. Link to comment
