Below are the details : I had filed I140 and I485 concurrently in July, 2007 but my I140 was denied and we appealed the case so my I485 was moved to AAO too. We started another labor and my I140 got cleared in EB2 catg. I am going to be current in Feb VB so i wanted to know if i can use existing I485 which is in AAO or do i need to file a new I485. Is it recommended to withdraw my AAO I140 so my new case can continue smoothly and i wont have multiple I485 with USCIS ? Link to comment
Belle Posted January 9, 2012 Report Share Posted January 9, 2012 My understanding is that you may file another appeal (or ammendment) that says that you have another immigrant petition that you want to use for adjustment or you may just file another I-485, and withdraw the appeal. If you have maintained status (like, H1), filing another I-485 makes better sense. Link to comment
