Approved I-140, in India for 3 years. Can I file I-485? Please suggest.

Hi,

I was in States between 2005 - 2008. I have an approved I-140 with Priority date of Dec 2007. I wanted to know can I proceed with next step in GC processing while being in India.

For an I-485, you would have to be in the US in a valid status.

From abroad, you could only go for Consular Processing. This involves filing an I-824.

Also, the job from the original employer still has to be available. You would have to get a notarized job offer letter from them.
