risehotsun Posted January 5, 2012 Report Share Posted January 5, 2012 I am a student enrolled in one of the universities (accredited) as a fulltime student.I have applied for H1 in general quota in November 2011 and got an FRE on Nov 22nd 2011, I have answered it with in 25days but my status is still in RFE stage. Now the problem is my F1 visa is valid till DEC 2011. I am worried about what my status is currently and also wondering whether I have to register in my university for this quarter or not. Is it legal to stay in USA currently ? Is it compulsory that I have to register for courses in the university ? (because my H1 is still under processing) Please do tell me what I should do , I am more worried and don't want to be out of status unknowingly. Please advice Priya Link to comment

JoeF Posted January 12, 2012 Report Share Posted January 12, 2012 First of all, you haven't applied for an H1. Your prospective employer has. And the employer would have had to answer an RFE. As long as the H1 is pending, you are legal. Link to comment
risehotsun Posted January 14, 2012 Author Report Share Posted January 14, 2012 Thanks for the information Joe., my employer has answered the RFE (sent all the Docs to USCIS regarding the query), but It still shows RFE status.
