However i have joined company B and currently working with B. SO my question is what happens if my visa get rejected. Do i have to travel back to india ? If Yes, can my compnay file a new H1B visa immediately or I need to wait until next year quota is open. Since this years quota is already full and completed . Please adivse , thanks in advance. Chitown01 Posted January 6, 2012 Report Share Posted January 6, 2012 When you were on H1 with company A, you were already counted towards the qouta. So now you are Cap Exempt. If your visa gets rejected and new employer is ready to file for H1, they can file new petition right away since you are cap exempt Link to comment

Company B is saying that they will file a new visa again if it gets rejected( visa transfer from A-->B). And probalbly i might have to travel back to india for few weeks. Is this correct ?
