Attorney_9 Posted December 30, 2011 Report Share Posted December 30, 2011 You and your employer should consult with a competent immigration attorney to determine the best strategy to proceed. Depending on the reason for denial, your employer may be able to file a Request for Reconsideration/Review on the denied case which would cause the status to revert back to "in process" and you then may be able to use that pending LC as a basis to extend your H1B, if the LC was originally filed at least 365 days before the end of your 6 years of H1B status. This is my 6th year i have vissa still june 31,2012 i heard that to stay in USA before my present vissa i should clear my labour and I-140 for my next extension is this true?? Link to comment
sel1 Posted January 18, 2012 Report Share Posted January 18, 2012 As long as your LC filed before start of 6th year and still pending, you can apply for one year extension at a time, assuming if your I-140 is approved you get 3 years extension at a time. Hope this helps Link to comment
