coria Posted December 28, 2011 Report Share Posted December 28, 2011 Hi all, USCIS recently denied my I94 extension after sending RFE, but my old approved L1B VISA has expiration date as Dec-2012, in this situation can I travel to US with the old approved VISA before Dec-2012? PS. The reason my employer filed the extension is because my I94 was expiring on Feb-2011, because my old passport was expiring on Aug-2011 (quite a story :() Link to comment

Attorney_23 Posted December 29, 2011 Report Share Posted December 29, 2011 A foreign national who accumulates more than 180 days of unlawful presence and then departs the U.S. will generally be subject to an automatic 3 year bar from reentering the United States. Also, his/her U.S. visa is generally deemed void. If you are interested in returning to the U.S., I highly suggest you contact an experienced attorney. Link to comment
