RFE ON L1 A EXTENSION

My husband's company did apply for L1 extension and Green Card on EB1 category

His visa is valid till jan 2012.

he came to usa in 2005 September. (He got visa in jan 2005)

He got EAD approved on December 10 2011, based on i-485.

But I140 is still pending.

He received RFE for L1 extension on nov 7. His company did not let him know at all.

on dec 27 he came to know about RFE.

RFE says he already completed 7 years and why he need extension.

But according to my husband he entered usa in 2005 September.

Please suggest what are the possibilities for us

Your husband may be able to simply provide evidence of when he first entered the U.S. For example, airline tickets, documents evidencing he was outside the U.S. for a period of time, etc.
