I have approved petition from say company A, i went for visa stamping to mumbai on company A's petition and i got 221(g) blue asking more supporting documents from the petitioner. Meanwhile my current company is interested in filling my H1B petition, but as you might be aware the cap has reached. Now my query is: Can my current company fill a cap-exempt petition for me? As i already hold a valid petition. I have never been to US on H1B earlier Your advise on the same will be highly appreciated. Link to comment
JoeF Posted December 24, 2011 Report Share Posted December 24, 2011 If you have an approved H1 petition under the cap, you are already counted for the cap and are not counted again. The new company can file an H1 for you at any time. Link to comment
