ambr020411 Posted December 21, 2011 Report Share Posted December 21, 2011 Hi- I will be joining new employer in First week of Jan'2012. It has been agreed to start my PERM process immediately. My H1 expires in Jun 2013. Given the current lead time in Prevailing wage determination and reg. recruiting (min 2months) will I be able to meet the 365 day filling date? If not, I read somewhere that one may file PERM even after 365day filing date. And in such cases if my PERM gets approved before Jun'2013 ( H1 expiry) - I shall be able to extend my H1. maddygonemad Posted December 22, 2011 Report Share Posted December 22, 2011 Hi one correction. You can apply for PERM after 365 filling date. But in that case, your 140 needs to be approved as well to apply for H1B Extension. Just approved PERM will not do. Link to comment

Basically - I have only 6months ( till Jun'12 - my 5Th year h1 anniversary) before I can apply PERM without avoid any hassles in H1 Extension. Link to comment

aboppana Posted December 28, 2011 Report Share Posted December 28, 2011 if the PERM if filed before Jun 2012, your H1B can be extended beyond Jun 2013. if your PERM and I-140 are approved by Jun 2013, you are qualified for 3 year H1B extension, otherwise one year. Link to comment
