vishnu9399
Can anyone respond , what is the criteria for issuing the H1-B visa for 1 year. usually H1-b visa is given for a period of 3 years. I do hear that, if you apply in premium processing, USCIS is issuing visa for 1 year, is that true? if you apply in regular processing, they are issuing for 3 years. Thanks, Link to comment
murphyd
Are you EVC or E-C model ? How long is your client contract ? You are misinformed premium processing has nothing to do with H1 duration. Link to comment
Scorpio811
Some of my Physicaltherapy friends got 1 year H1B visas recently. Their attorney explained this that since they do not have their PT license, they have a year to come here, work in temporary license & get their full license & then get a 3 year H1B Link to comment

livliv
If the employer can prove that work is available for 3 years, they will give 3 years. If the employer can only prove 1 year, they will approve for 1 year. Link to comment
vishnu9399
Do you mean, in the I-129 petetion, if the employer mention the job end date(not the project end date at client) as 1 year, they approve for 1 year?? As far as my knowledge : I-129 application, there is a field as job end date.. Thanks, Link to comment
livliv
In case of consultants, USCIS requires more proof than just a requested end date. They want to see a client agreement to confirm that a job is available for more than 1 year. Link to comment
