Morpheus1 Posted December 18, 2011 Report Share Posted December 18, 2011 Hi, I left my job with company A, to join company B, after my I-140 was approved (through company A). Company A did not revoke my I-140. In 2 months I had to leave company B to join company C. While working with company B my priority date became current. Can I retain my priority date in company C or does it get reset ? Your suggestions/comments are hugely appreciated. Thanks and Regards Link to comment
Attorney_17 Posted December 19, 2011 Report Share Posted December 19, 2011 Company C will need to file a new PERM application and I-140 petition on your behalf. At the time of filing the I-140 petition, Company C can request that the earlier Priority Date (from Company A's I-140 approval) be retained. Link to comment

My Priority date is current but my new company has not started PERM yet and it seems the company that has approved 140 is no longer in business. It was a desi consulting firm and from what I understand its closed due to IRS issues. They sure did not revoke my 140 though. Now I am with a reputed American Company in good standing. New company needs atleast 4-6 months to file PERM (publish the add, cool off period etc) .. I really hope I can retain the PD even though original company is closed. Are there any circumstances I may not be able to retain PD? Link to comment
