I have to be filing for my 485 application in January and I am adding my wife. I have 2 questions regarding I-134 Affidavit of Support application form: 1) My wife is a PH.D student (F1 visa) and she had full assistantship(her payroll amount (19000$ per year) is included in my tax returns) so which one I have to select “Wholly Dependent” or “Partially Dependent” in item(8) ? 2) Item (11) – I “Intend” or “Do not intend to make specific contribution to the support of the person(s) name in Item (3): ==> Which one I have to select “I Intend” or “Do not intend”? JoeF Posted December 19, 2011 Report Share Posted December 19, 2011 FOrget the I-134. It doesn't apply in your situation. It is only for non-immigrants, and even then, courts have ruled that it is not enforceable. If you are employment-based, an affidavit of support is not needed for the dependents. The dependent just files an I-485 based on your I-140. Link to comment
