livliv Posted December 16, 2011 Report Share Posted December 16, 2011 Are you talking about applying for H4 Visa at a consulate or filing for change of status to H4 from some other status? The H4 spouse can complete both the applications on his/her own. The H1 principal's employer need not be involved. Link to comment

livliv Posted December 20, 2011 Report Share Posted December 20, 2011 Search for form I-539 and instructions on USCIS website. You will need to provide proof of current status (H1 I-94, paystubs), proof of spouse's status (spouse's H1 I-94 paystubs), passport copies, and proof of relationship (marriage certificate). livliv Posted December 20, 2011 Report Share Posted December 20, 2011 To add to the above, it takes 2 to 3 months to get a decision. You can quit your job after application is received by USCIS and you must stop working after it is approved. Link to comment
